The right of withdrawal, commonly known as the "right to reconsider", is one of the most important rights recognised to consumers by the Consumer Code. It is governed by Legislative Decree No 21/2014 which transposed Directive 2011/83/EU on consumer rights. The right of withdrawal allows the consumer to change his mind about the purchase made, freeing himself from the contract concluded without giving any reason. In this case, the consumer can return the goods and obtain a refund of the amount paid.
The right of withdrawal, governed by Articles 52 et seq. of the Consumer Code, is provided only for contracts concluded at a distance or negotiated away from business premises, between a professional and a consumer. In the case of a purchase made online and subsequently withdrawn in store, the right of withdrawal can be equally exercised, since the withdrawal concerns the executive phase of the contract and does not alter the nature of a contract concluded at a distance.
Article 54 of the Consumer Code provides that before the expiration of the withdrawal period, the consumer must inform the trader of his decision to exercise the right to withdraw from the contract. For this purpose, the consumer may use the form in his account. The professional is required to confirm, without delay and on a durable medium, the receipt of the communication about the exercise of the right of withdrawal. The burden of proof regarding the exercise of the right of withdrawal in accordance with the rules of the Consumer Code is on the consumer.
The trader may demand payment during the withdrawal period of fourteen or thirty days provided that the consumer has made an explicit request to receive the contracted service before exercising the right of withdrawal. Pursuant to Article 57, paragraph 3, of the Consumer Code if the consumer has made a request for activation of the supply, performance of the service during the withdrawal period, he is responsible for payment to the trader of an amount proportional to what has been provided up to the time when the consumer informed the trader of the exercise of the right of withdrawal, with respect to all the services under the contract. The proportional amount to be paid by the consumer to the trader is calculated on the basis of the total price agreed upon in the contract. If said total price is excessive, the proportional amount shall be calculated on the basis of the market value of what was provided.
The exercise of the right of withdrawal releases the parties from their contractual obligations undertaken to perform the distance or off-premises contract or to conclude a distance or off-premises contract in cases where an offer has been made by the consumer (Article 55 of the Consumer Code).
